WAIVER OF LIABILITY, ASSUMPTION OF RISK, DISCLAIMER & PRIVACY POLICY

NOTICE REGARDING LIABILITY LIMITATIONS WITH RESPECT TO BUNKER CYCLING STUDIO FITNESS SERVICES

By agreeing to this Agreement and participating in any BUNKER CYCLING STUDIO classes, including but not limited to indoor cycling, strength training, resistance training, functional fitness, conditioning, mobility, personal training, workshops, events, activities, or programs, whether at a BUNKER CYCLING STUDIO facility or using BUNKER CYCLING STUDIO equipment, you acknowledge and agree, on behalf of yourself, your heirs, personal representatives, and assigns, that:

  1. Assumption of Risk

The BUNKER CYCLING STUDIO fitness programs—including indoor cycling, strength training, resistance training, functional fitness, conditioning, mobility, and related fitness classes—involve inherent risks due to their strenuous physical nature. These risks include, but are not limited to:

  • Muscle strains and tears
  • Sprains
  • Ligament and tendon injuries
  • Joint injuries
  • Falls
  • Equipment-related injuries
  • Cuts, bruises, and abrasions
  • Overexertion
  • Dehydration
  • Heat-related illness
  • Rhabdomyolysis
  • Heart attack
  • Stroke
  • Permanent disability
  • Death

You understand and voluntarily accept these risks.

  1. Voluntary Participation

You have willingly chosen to participate in an intense physical exercise program and acknowledge that participation is entirely voluntary.

  1. Medical Recommendation

It is strongly recommended that you consult with a licensed physician before participating in any classes, particularly if you have any medical condition, injury, pregnancy, cardiovascular disease, respiratory condition, or other health concern.

  1. Acknowledgment of Physical Demands

You have been fully informed about the demanding nature of these exercise programs, including cardiovascular exercise, resistance training, weightlifting, bodyweight exercises, functional movement, and high-intensity interval training. You understand that participation may result in adverse physiological events including, but not limited to:

  • Abnormal blood pressure
  • Dizziness
  • Fainting
  • Muscle tears
  • Fractures
  • Rhabdomyolysis
  • Heart attack
  • Stroke
  • Permanent disability
  • Death
  1. Release and Waiver of Liability

You voluntarily assume all risks associated with participation in BUNKER CYCLING STUDIO fitness activities, including the use of bicycles, free weights, barbells, dumbbells, kettlebells, resistance bands, benches, mats, functional training equipment, and any other exercise equipment provided by the studio.

To the fullest extent permitted by applicable law, you release, waive, discharge, and hold harmless BUNKER CYCLING STUDIO, its owners, officers, directors, employees, instructors, independent contractors, agents, affiliates, volunteers, and members from any and all claims, liabilities, demands, actions, causes of action, damages, losses, costs, or expenses arising out of or related to your participation in any BUNKER CYCLING STUDIO activities, including personal injury, illness, property damage, disability, or death, whether arising from ordinary negligence or otherwise, except where prohibited by law.

STRENGTH TRAINING ACKNOWLEDGMENT

I understand that strength and resistance training involves lifting, carrying, pushing, pulling, and moving weights or resistance equipment that may result in injury if not performed correctly.

I agree to:

  • Follow all instructor directions.
  • Use equipment responsibly.
  • Exercise only within my personal physical capabilities.
  • Stop exercising immediately if I experience pain, dizziness, nausea, shortness of breath, chest pain, or any unusual symptoms.
  • Notify an instructor immediately if I become injured or experience discomfort.
  • Inform my instructor of any medical condition, injury, surgery, pregnancy, or physical limitation that could affect my safe participation.

MEDICAL REPRESENTATION

I represent that I am physically capable of participating in BUNKER CYCLING STUDIO fitness classes.

I understand that it is my responsibility to obtain medical clearance from a licensed physician before participating if I have any health concerns or pre-existing medical conditions.

I accept full responsibility for monitoring my own physical condition during participation and agree that BUNKER CYCLING STUDIO is not responsible for determining whether I am fit to participate.

For individuals enrolling minors (individuals under the age of majority in their jurisdiction of residence), this Release and Waiver applies equally to the minor participant.

Participants must be 15 years of age or older.

Participants between 15 and 17 years of age may participate only with the written consent of a parent or legal guardian and in accordance with BUNKER CYCLING STUDIO policies.

DISCLAIMER

Services Provided

BUNKER CYCLING STUDIO provides indoor cycling, strength training, resistance training, functional fitness, conditioning, mobility, wellness, personal training, workshops, and related fitness services through its studio, website, and mobile applications.

These services are provided on an «AS IS» and «AS AVAILABLE» basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, accuracy, completeness, uninterrupted availability, fitness for a particular purpose, or non-infringement.

Third-Party Interactions

BUNKER CYCLING STUDIO disclaims all liability for products, services, information, or conduct provided by third parties that may be accessed through or in connection with our services.

Limitation of Liability

To the fullest extent permitted by applicable law, BUNKER CYCLING STUDIO, its owners, employees, instructors, contractors, affiliates, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

  • Loss of profits
  • Business interruption
  • Loss of reputation
  • Emotional distress
  • Data loss
  • Loss of use

Our maximum aggregate liability for any claim arising from your use of our services shall not exceed the total amount paid by you to BUNKER CYCLING STUDIO during the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit limitations on implied warranties or exclusions of certain damages. In those jurisdictions, portions of these limitations may not apply.
